Market gap
New York's synthetic-performer disclosure law (GBL 396-b) took effect June 9, 2026, the first state law requiring advertisers to conspicuously disclose when an ad features an AI-generated performer. Roughly a dozen more states now have live or pending versions of the same idea, each with its own wording, trigger, and penalty structure. Meanwhile AI-avatar ad creation has gone mainstream fast: HeyGen alone reports 100,000-plus business customers and $200 million in ARR. Every agency and brand running that creative in a normal multi-state digital campaign is now exposed to a patchwork of disclosure rules that didn't exist eighteen months ago, and the only response so far is law firm memos, ad-platform AI labels that don't match state statute wording, or an enterprise composable-CDP feature (Hightouch Ad Studio) that requires a mature data warehouse most small agencies and brands don't have. Timing is right now: NY is live, California's AI Transparency Act deadline lands August 2, 2026, and the state list is growing monthly.

Bottom-up, starting from two public anchors:

Assumptions (stated plainly, since this market didn't exist as a category before 2026):
- Roughly 60,000 unique businesses across these tools produce AI-avatar creative specifically for paid advertising rather than internal training, HR, or education content. This is a conservative slice of HeyGen's disclosed base plus other tools, deliberately not summed to avoid double-counting.
- Blended ACV of $1,800/year across a $99 to $299/month tier spread.
- TAM: 60,000 x $1,800 = $108M.
- SAM: half of that TAM actively manages state-level ad targeting and would recognize the compliance gap enough to buy a dedicated tool: 30,000 x $1,800 = $54M.

- ReedSmith issued a client alert specifically warning advertisers ahead of the New York compliance deadline: "Fake performer, real penalty: What advertisers need to know before June 9". A national law firm building urgent client guidance shows real, billable client demand for help with this exact problem.
- MarketingBrew, trade press for the marketing industry, covered the law as a live "pressure test" for marketers already running AI-generated-performer ads: "How New York's AI disclosure law could change transparency in advertising".
- AdExchanger confirms the scale of the patchwork problem directly: fourteen states now have live or pending disclosure laws that "don't agree on wording, triggers, or penalties": "AI Disclosure Requirements: Navigating State Laws And Platform Rules".
- Hightouch already built and markets a disclosure-automation feature (Ad Studio) directly in response to the New York law: "New York's AI advertising regulation goes into effect today. Are you ready?". A real company shipping a paid feature for this exact workflow is itself evidence the commercial need is real, even though its own delivery leaves a gap (see below).
Competitors
- Hightouch (Ad Studio, part of its Agentic Marketing Platform): ships visible disclosure labels and machine-readable watermarking for AI-generated ad people today, with brand-level rule configuration. But it's built on top of Hightouch's composable CDP, which targets mid-market and enterprise teams that already run a mature Snowflake, BigQuery, Databricks, or Redshift warehouse. A small agency or solo DTC brand with no data warehouse cannot adopt it without buying into the whole platform.
- HeyGen, Arcads, Synthesia, Captions: the AI-avatar and UGC-style ad creation tools actually generating this content at scale (HeyGen alone: 100,000-plus businesses, $200M ARR). None of them maintain a state-by-state legal rules engine, verify the specific statutory wording or placement each state requires, or produce a compliance audit trail. They create the content; they don't prove it's disclosed correctly.
- Meta, TikTok, YouTube, Google native "AI info" labels: platform-level, self-declared toggles applied at upload. They satisfy platform policy, not state law, and don't cover creative served outside those exact platform flows (direct site placements, email, CTV).
- Law firms (McDermott, ReedSmith, Crowell & Moring, Manatt): publish detailed one-time client memos and advisories on the new laws, but no operational software that classifies creative at scale or proves disclosure compliance on an ongoing basis.
What competitors offer now
Hightouch's Ad Studio is the closest real feature match but is bundled inside an enterprise composable CDP purchase, requires an existing cloud data warehouse, and is marketed to data and marketing-ops teams at companies that already have that infrastructure. The AI-avatar creation tools stop at generating the content. The ad platforms' own labels are voluntary, platform-specific, and don't map to what each state statute actually requires an advertiser to display. Law firms sell one-time advice, not a system that keeps working as more states pass their own version of the law.
What can be done differently to attract customers
Ship a standalone tool that needs nothing but a video or image upload and a list of target states: no CDP, no data warehouse, no ad-account migration. Maintain a living rules engine that tracks every state's disclosure law as it goes live (NY today, California and others on the way) and generates each state's specific required wording rather than a generic "AI generated" badge.
